olqe 考過後申請律師牌的步驟 steps after passing the OLQE
自從寫了兩篇（1、2）關於香港olqe考試的文章後，我以為這個事情可以就這樣結束了。。。因為接下來要再去取得律師牌，無非是要（以下信息獲得於2021年，不能作準或被依賴，僅為個人體驗，建議如果有任何疑慮直接聯繫各機構確認 all information below, which are solely based on personal experience, should not be relied upon. If in doubt, please contact the relevant authorities.）：
1、用考試通過的通知向律師會申請一個什麼certificate（3號表格），為此，要填一個叫1C的表格，一個5號表格，同時律師會還需要給他們發一個你會去拿律師牌的通知（notice for… practise certificate之類）
A Form 3 certificate is needed for admission. To obtain the Form 3, you’ll need to file a Form 1C, a Form 5, and a Notice for applying a practising certificate with the Law Society.
這裡1C表格的填寫有些律師會沒說的事情：
(a) 香港身份證的ctc要用跟填寫說明上面不一樣的語言來certify。。。一般律師有那個章，總之要說明那個文件是 true and complete copy of the original
the certification language for the HKID should be different from the sample provided. a solicitor’s stamp for certified true copies should suffice (which contains the language “true and complete copy…”)
(b) 紐約第一部門不發admission certificate的問題再次浮現。。。這次要多做一個declaration
needs a separate declaration for 1st dept NY qualified attorney. The law society will provide a sample when giving the 1st feedback.
(c) 填通過的考試的時候，要把所有的head全部寫出來
needs to specify all heads in the olqe in Form 1c
(d) 要證明你這三個月都在香港，除了填寫說明裡的護照，還要提供租房合同，水電煤賬單，以及僱主證明
might request additional documents to prove that you are in HK during the 3 month period, such as lease, water/power/gas bills, employment reference.
2、拿到那個certificate，向高等法院file 一個motion，請一個律師move你被法院admit（如果是inhouse，motion是per se去file的，但是mover還是要有個律師，是分別的）；這個動作要在收到certificate原件後2個月內去弄；motion paper和certificate的copy要向律師會和律政司提供（motion paper不要找律師certify，法院會蓋印；certificate要做兩份certified true copy，「ctc」），另外還要向法院和律師會寫一封信，告訴他們誰會做你的mover（一定要按照信的格式來，不然會被拒收。。。）。總之：
After receiving Form 3, you need to file a notice of motion with the High Court. If you are in private practice, you can ask the firm to do all these. If not, you will have to file the motion per se (not the same with having a mover). The notice needs to be filed within 2 month after receiving the Form 3. The notice should not be certified, as the court will certified the copies of the notice themselves. A letter (must be in a letter format) should also be handed to the High Court and the Law Society, informing them who will be your mover.
(a) 準備form3的certificate的兩份ctc
prepare two certified true copies of your Form 3
(b) motion paper 準備一份原件，兩份複印件，不要做ctc；如果inhouse，motion paper的格式要稍微改一下，寫成以applicant自己的名義去move（除非你請律所幫你file那個motion）
prepare one original notice of motion, and make two copies. The copies should not be certified. The format of the notice needs some format changes if applying per se (applying as the applicant, not as a solicitor)
(c) 準備一樣的信兩份，告訴法院和律師會誰會做你的mover
prepare two letters informing the high court and the law society regarding your mover
如果你是inhouse，拿着上面三份文件去high court（如果你是律所律師直接交給你的秘書搞定）。先去金鐘的high court building： take all documents to the High Court
(a) 的LG2層繳費，他們會在你的motion上印上已繳費的字樣
go to LG2 to pay the fee; they will print on your motion paper that the fees are paid
(b) 再去LG1（LG1在LG2的樓上，依此類推）找個窗口，裏面的人會檢查格式什麼的，然後給你一個案號
go to LG1 (above LG2); they will check if your docs are in order, and assign you a case number
(c) 去G層（在LG1的樓上）的clerk那裡（1號窗口A/B）確認宣誓日期，他們會填到你的motion里去（我當時是三四個月後）；把時間信息填入準備的另外兩份motion paper的複印件上
go to G level (above LG1) and find the clerk (Window 1 A/B when I was there) and fix the admission date. Could be 3 to 4 months later. Fill in the admission date on the two copies of the motion paper.
(d) 回到LG1剛才那個窗口，正式file你的motion，窗口會在你的兩份motion paper複印件上蓋法院的印章（他們就不能把這些窗口集中一下或者至少放在同一層嗎。。。）
go back to LG1 and file your motions. The clerk will affix court seal on your copies of the motion paper.
(e) 分別拿着你的其他文件交給律政司（在聖公會的聖約翰座堂背後）和律師會，律師會的要多那份信
hand a copy of your motion paper and a copy of your Form 3 to the Department of Justice. hand the same things plus the letter regarding the mover to the Law Society.
自此，就是等待宣誓。。。還要租律師袍什麼的。等宣誓完了才能去apply for practice certificate
Rent and borrow robes for yourself and the mover.
另外，律政司的信打電話問了，會在admit之前一個星期的時候寄出來，所以收到的時候也快要去admit了。。。最好留一個fax號碼以便接受這種東西
The DOJ will send you a letter of no objection (if they really are not objecting). The letter might arrive within one week before your admission date. Better leave them a fax number for this.
離宣誓還有兩周的時候，法院會fax給你（如果有留fax nubmer）或者寄給你一封信，有關宣誓的具體細節。
Approx. 2 weeks before the admission, the high court will fax you (if you left a fax number) or send you by post a letter regarding the details of the admission ceremony.
3、去法院宣誓
宣誓那天，根據法院寄來的信的說法，可以一共帶8個人進去（包括mover），mover要講三分鐘的話。如果因為疫情，可能也會改成書面替代講話，能進去的人也可能減少為5個。拍照必須在指定時間指定場所（但不是在法庭內，也不能在高院正門太近的地方）。
Per the letter from the high court, a total number of 8 people (including the mover) can accompany the applicant to enter the courtroom. For the purpose of preventing the pandemic, the oral speech by the mover might be substituted by a written speech, and the number of people might be decreased to 5. Photos can be taken at specified time and specified location, but not inside the courtroom, nor in close proximity of the front of the high court building on the ground floor.

給師兄update一下我的OLQE之路：因為我之前在香港拿到過PCLL（各種原因畢業後回深圳了），我可以根據Rule 5(2)申請豁免OLQE的所有考試，as long as我在大陸做見習律師+執業律師滿三年。我在大陸做見習律師期間轉過律所，見習期間斷需要從頭算，BUT香港law society稱大陸的見習律師無論多長他們只承認法定的期限（即1年），這麼一來我就見習+執業不滿三年了。so今年OLQE之旅走到了盡頭……

兄弟你是在律所還是inhouse？我今年考剩下的一門Head IV，大概率明年能通過，可是我很可能4月份換工作，從律所去inhouse，所以就不知道在等待admission的期間換去inhouse是不是會影響admission。兄弟你一定需要僱主出具或辦理，繞不開的項目有哪些呢？

如果你申請admission（拿form 3的certificate）的材料交了以後才轉換工作應該不影響。如果你還沒交，有關僱主需要提供的東西，其實律師會想找你要的是一個能證明你在申請後三個月（或者其他允許的時間段內）還有權留在香港的文件（我理解如果你已經有永居了應該不需要僱主提供什麼東西證明，但具體應以律師會的反饋為準），所以只要你任何一個僱主提供的東西能反映這個情況就可以（隨便找張公司的信頭紙寫下這種內容然後找一個願意幫你簽字的公司的人簽一下）。
我當時在inhouse的時候所有的一切都是自己搞定的，如果你還在律所，很多東西可以讓律所幫你搞（有很多東西需要打印在信頭紙上）。如果你律所不知道你要走當然還是可以讓你律所幫你了。

一年又一年，今年再次提交申請，還沒等到回復……根據去年的經驗，會在五一假後有結果。等待的時間真難熬……

果然又有新的問題出現：申請Certificate of Eligibilty for Admission需要提交Form 1C，而Form 1C顯示需要在香港的非本所Solicitor/Commissioner for Oaths面前簽字，而我現在還沒有去香港的working visa（個人游簽證還停辦了……）。如果現在辦Working Visa，則Law Society需要我提供form 1C才會給一個non-objection letter……陷入死循環了

你那邊使勁找的話也許可以找到一個香港律師吧。。。實在不行的話內地公證處可以嗎，你問下law soc 試試
我記得好像一共有三個表，有一個表還得再找一個香港律師。。。你可以看下我上面文章也許提到了
當然最終你還是需要一個工簽的，因為有要待三個月的規定，除非你已經pr了

考的人其實不少，每年大概50到200之間（具體看考哪個head），等你找了培訓機構就會碰到很多正在考的人

我沒申exemption，除了common law自動exempt的head 6。當時聽說一般只能exempt掉2和3，即便有很多年經驗

motion paper的sample在olqe那個package里有的啊，只需要把所有firm的地方換成the applicant即可。其他的格式問題我是問的high court的那個clerk，就是你file的時候他們會檢查格式的。另外還需要一些文件，你可以打電話過去問也可以自己去金鐘。你也可以問下做liti的朋友讓他們幫你檢查下格式。
mover的話inhouse的solicitor即可。
